Flixdisc License Agreement View All Discs by Flixdisc FlixDisc Royalty Free End User License Agreement
This is a legal agreement between you and FlixDisc, Ltd. ("FlixDisc"). Please read this Agreement carefully before using any image, moving or still ("Image") from this Filmclips CD-ROM ("CD"). By using an Image you agree to be bound by this Agreement.
Copyright
FlixDisc owns the copyrights to all the Images on this CD. These rights are protected by United States copyright laws, international treaty provisions and other applicable laws. All rights not specifically granted to you by this Agreement are prohibited.
Permitted Uses
By purchasing this CD, FlixDisc grants you, and your employer if you are licensing on behalf of your employer, a non-exclusinve, non-sublicensable right to use the Images on this CD on your personal computer for use in Advertising, Print, Broadcast, Video, Motion Pictures, Promotions, Multimedia or the Web and any Test or Sample use.
You may allow no more than 10 individual users to use the Images or CD's, provided that all 10 are employed under contract to the licensee.
You may make modifications or derivative works of any Image on the CD. You may make one copy of the Images for backup or archival purposes.
You may not sell, rent, loan, sublicense or otherwise transfer to anyone either the CD or an Image, or right to use the CD or an Image (except insofar as stated above), and nothing you produce shall grant or purport to grant to any third party a right to use or duplicate an Image.
Pornographic, defamatory, libelous or otherwise unlawful use of an Image is prohibited.
No Image may be sublicensed, resold or otherwise made available for use or distribution separately or detached from a product. You may not make some or all of the Images available on your web page as a separate, downloadable reusable file.
Warranty
FlixDisc warrants the Images and disc to be free from defects in material and workmanship for 90 days from delivery. The sole and exclusive remedy for a breach of the foregoing warranty is the replacement of the Images or CD, at FlixDisc's option. FlixDisc makes no other warranty, express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. You agree to indemnify and hold FlixDisc harmless against any damages or liability of any kind arising from any use of an Image. Neither FlixDisc nor any of its directors, officers, employees, partners, licensers, or agents shall be liable for any damages, whether direct, indirect, consequential or incidental, arising out of the use of, or the inability to use, the CD or an Image or any other damages arising out of this license or otherwise.
Governing Law
This Agreement shall be governed by the laws of the State of Illinois, except its conflicts of law rules. Venue for any action respecting this Agreement, or an Image, or use or attempted use if the CD, shall be in the State of Illinois.
FlixDisc has the right to automatically terminate this agreement without notice if you, or your employer if you are licensing on behalf of your employer, fail to comply with any provision of this agreement.
